It's Off To The Races In The Libby Case

According to the AP, Judge Walton has ordered the CIA to provide Libby's defense team the PDB's . If this report is correct, the order is broader than many of us expected. Stay tuned.

Interesting the AP casts it as a battle with the Bush Administration.

The CIA and the President do have a say in whether the pdbs will be released.

It would be rather extraordinary if the Executive agreed to the order. I would rather the case be tossed on the premise that Fitz was wrongfully appointed but I'd bet on dismissal on a number of different points before I would put a dime on a trial.

The judge has delayed deciding on Libby's right to discovery on what the govt has on Plame's "classification" and harm to national security--which Fitz has said is not relevant. I hope the Judge says that if Fitz doesn't turn it over he cannot make any reference to it at trial.
